Reckless DrivingReckless driving is a serious offense in California. This ticket comes with steep fines and penalties. In addition, the citation comes with criminal charges, which stay on the driver’s record permanently.

The laws regarding this offense are covered by California Vehicle Code 23103. Section A of this vehicle code states that “A person who drives a vehicle upon a highway in willful or wanton disregard for the safety of persons or property is guilty of reckless driving.” Section B goes on to add off street parking facilities to the possible locations for reckless driving.

The fines and penalties for this offense are very steep. For the first offense, a driver found guilty of the offense faces a jail sentence of 5 to 90 days, a fine of $145 to $1000, 2 points on their license, and a possible license suspension, depending on the circumstances. When the event causes bodily injury or death to a person other than the driver, the fines and penalties increase and the offense may be charged as a felony instead of as a misdemeanor.

When the reckless driving is committed in an effort to avoid law enforcement, the charges become reckless evading. Reckless evading is covered by California Vehicle Code 2800.2. This offense is charged as either a misdemeanor or a felony, and it carries hefty fines, a license suspension, a jail sentence, and 2 points on the driver’s license.
